PRINCIPALES INSTITUCIONES (CENTROS) DE ARBITRAJE INTERNACIONAL EN EL MUNDO

International Chamber of Commerce (ICC)

The Arbitration Court of the ICC is the leading and perhaps most-used arbitral institution in the world. It is also one of the oldest and most trusted institutions, with a very large caseload involving parties across a wide spectrum of industries. It also administers investor-state disputes. The ICC’s arbitration rules have stood the test of time, are well known and trusted. Likewise, the Secretariat and the Arbitration Court (both administrative organs of the institution) are highly respected. Although principally based in Paris, France, the ICC is considered to be an international, neutral and impartial institution.

American Arbitration Association (AAA)

The AAA is a preeminent arbitral institution in North America, with an important caseload of both international and domestic arbitrations. Although the AAA has an international arm, the ICDR, its rules are perfectly adapted to international disputes, and are considered neutral and of high quality.

International Centre for Dispute Resolution (ICDR)

ICDR is the international arm of the AAA, and handles arbitration disputes of an international nature. Its rules are considered to be of high quality and neutral. Since its inception, the ICDR’s caseload has increased, and the submitted disputes include a wide range of industries.

London Court of International Arbitration (LCIA)

The LCIA is another old and well-known arbitral institution. Based in the United Kingdom, it is, like the ICC, considered to be a very neutral and competent institution. Its rules are well-established and highly trusted amongst users of arbitration.

International Centre for Settlement of Investment Disputes (ICSID)

ICSID is an international arbitral institution established by a multilateral treaty (colloquially known as the ICSID Convention) and based in Washington, DC. ICSID was created by the convention as an impartial forum for the resolution of legal disputes between eligible parties, through conciliation or arbitration procedures. As such, it is specialized in investment disputes between investors and states. ICSID has a significant caseload and plays an important role in international investment and economic development.

Permanent Court of Arbitration (PCA)

The PC is an intergovernmental organization based in The Hague, Netherlands. It administers private, intergovernmental and interstate arbitrations. The PCA is frequently designated as an administering authority when parties to a contract have otherwise opted for ad hoc arbitration (i.e., the parties did not designate an arbitral institution in the arbitration clause to their contract). In such a case, under the UNCITRAL rules and subject to the parties’ agreement, the PCA will administer the arbitration by appointing arbitrators or designating an appointing authority, thereby avoiding one of the major potential stumbling blocks of ad hoc arbitration.

Arbitration Institute of the Stockholm Chamber of Commerce (SCC)

The SCC is the leading arbitral institution in Sweden and Scandanavia as a whole. Many of the disputes that designate the SCC involve former Soviet states. The SCC is also sometimes designated as a neutral institution between parties who have no other connection to Sweden.

China International Economic and Trade Arbitration Commission (CIETAC)

Besides the HKIAC, CIETAC is considered the leading arbitral institution in China. With the rise of China as a global economy, CIETAC has enjoyed increasing importance and is often designated in disputes involving one or more Chinese parties.

Dubai International Arbitration Centre (DIAC)

DIAC is a competitor to the DIFC. DIAC administrative fees are generally less expensive than DIFC fees. A major difference between DIAC and DIFC is that DIAC is located in Dubai, and awards issued there are subject to the control of the Dubai courts; by contrast, DIFC is an autonomous legal jurisdiction within Dubai with an independent judicial system and its own courts, which review DIFC awards.

Hong Kong International Arbitration Centre (HKIAC)

HKIAC is the leading arbitral institution in Hong Kong and vies with SIAC as the most important institution in the Asia Pacific region. HKIAC is considered by many to be more neutral and “international” than its Mainland counterpart, CIETAC. Hong Kong is also considered to have a more stable arbitration law than China. As a result, parties from other parts of the world often prefer to seat their arbitrations in Hong Kong as opposed to Mainland China, and designate the HKIAC as the arbitral institution rather than other Mainland-based institutions.

Singapore International Arbitration Centre (SIAC)

SIAC is the main arbitral institution in Singapore. It competes against the HKIAC as the leading regional arbitral institution. Like the HKIAC, it has a strong reputation as a neutral and impartial administering institution and enjoys a significant caseload. As with Hong Kong, Singapore enjoys one of the most modern arbitration laws in the region. SIAC is strategically placed to administer arbitration disputes involving oil, gas and natural resources in the region.

Swiss Chambers Arbitration Institution

The Arbitration Court of the Swiss Chambers Arbitration Institution is the leading institution in Switzerland. Located as it is in Switzerland, the institution enjoys a strong reputation as a neutral, impartial body and many parties will often select the Swiss Chambers, as well as Switzerland as the arbitral seat, as a neutral compromise.
